Queensland Rental Law Changes Effective 1 May 2025

Significant updates to Queensland rental legislation will take effect on 1 May 2025, impacting property owners, managers, and tenants across the state. These amendments, building upon earlier changes from June and September 2024, aim to streamline processes, enhance transparency, and ensure fair treatment for all parties involved in rental agreements.

 

Here’s a concise breakdown of the key changes and what they mean for you:

  1. Standardised Rental Application Form

From 1 May 2025, managing parties must use a standardised rental application form:

  • General tenancy or moveable dwelling: Use Form 22.
  • Rooming accommodation: Use Form R22.

Additionally, managing parties must:

  • Offer at least two different application submission methods, ensuring one method is not restrictive.
  • Comply with new guidelines on the permissible information collected from prospective tenants.
  • If offering online applications, ensure the form aligns strictly with standardised content.
  1. Personal Information Management
  • New restrictions limit the types of personal information property managers and owners can request and collect.
  • Personal information collected must now be destroyed within specified time frames to protect tenant privacy.
  1. Disclosure of Financial Benefits

Managing parties must transparently disclose any financial benefits they receive related to rent payments, enhancing trust and transparency in rental transactions.

  1. Increased Entry Notice Period

The required notice period for entry into a rented property will increase from 24 hours to 48 hours.

  1. Entry Frequency Limits

Post-issuance of a notice to end tenancy, there are new limitations on how frequently managing parties can enter a property.

  1. Requesting Fixtures and Structural Changes

Tenants wishing to attach fixtures or make structural changes must use the new Form 23 (Request for approval to attach fixtures or make structural changes). Managing parties are required to respond to these requests within 28 days.
